Terms of Service
1. Acceptance of Terms
By accessing or using the psiLynx platform at was.psilynx.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and psiLynx sp. z o.o., a company registered under the laws of Poland ("we", "us", or "psiLynx").
2. Description of Service
psiLynx provides an automated web performance monitoring platform that runs Google Lighthouse audits on URLs specified by users, tracks Core Web Vitals scores over time, generates reports, and delivers alerts based on configurable thresholds. The Service is provided on a subscription basis with plan tiers as described on our pricing page.
3. Account Registration
To use the Service you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@psilynx.com of any unauthorized use of your account.
You must be at least 18 years old and have the legal capacity to enter into contracts under applicable law to create an account.
4. Subscriptions and Payment
The Service is offered on a subscription basis. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis for the applicable subscription fee plus any applicable VAT or other taxes. All prices are shown exclusive of VAT unless otherwise stated. VAT will be calculated and added at checkout based on your billing country.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain access to the Service until that date.
We reserve the right to change subscription prices with at least 30 days' advance notice via email. Continued use of the Service after a price change constitutes acceptance of the new price.
5. Free Plan
We offer a permanent Free plan for new and existing accounts. No credit card is required. The Free plan includes limited capacity (checks per week, projects, URLs, and data history) as described on the pricing page. We reserve the right to modify Free plan limits at any time with reasonable notice.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to audit URLs or domains that you do not own or are not authorized to test. You agree not to attempt to circumvent plan limits, share account credentials with third parties outside your authorized team members, or use the Service in any way that could damage, disable, or overburden our infrastructure.
7. Intellectual Property
The Service and all its contents, features, and functionality — including but not limited to software, text, graphics, logos, and icons — are owned by psiLynx sp. z o.o. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
Reports generated by the Service based on your data remain your property. We retain the right to use aggregated, anonymized data for product improvement and analytics.
8. Limitation of Liability
To the maximum extent permitted by applicable law, psiLynx sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable EU or Polish consumer protection law.
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted, error-free operation. We may perform maintenance that temporarily interrupts the Service and will endeavor to provide advance notice when possible.
10. Termination
You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms.
Upon termination, your right to use the Service ceases immediately. Data associated with your account may be deleted after a 30-day retention period following termination.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
If you are a consumer in the European Union, you may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the changes.

Privacy Policy
1. Who We Are
psiLynx sp. z o.o. is the data controller responsible for your personal data. We are registered in Poland and operate the psiLynx platform at was.psilynx.com. You can reach our privacy team at privacy@psilynx.com.
2. Data We Collect
We collect: account data (email, name, password hash); billing data (name, address, country, VAT — card details handled by Stripe); usage data (URLs, projects, check history, alert configs); technical data (IP, browser, device, session); analytics data (via Google Analytics 4, anonymized).
3. Legal Basis (GDPR)
We process your data on the basis of: contract performance (Art. 6(1)(b)); legitimate interests (Art. 6(1)(f)); legal obligation (Art. 6(1)(c)); and consent (Art. 6(1)(a)) for analytics cookies.
4. How We Use Your Data
We use your data to provide and operate the Service; process payments; send transactional emails; respond to support requests; detect and prevent fraud; comply with legal obligations; and improve the Service through aggregated analytics. We do not sell your personal data.
5. Data Sharing
We share data with: Stripe (payment processing); Google Analytics (website analytics, anonymized); cloud infrastructure providers (hosting within the EU); email delivery providers. We may disclose data when required by law.
6. International Data Transfers
Where we transfer personal data outside the EEA, we ensure adequate protection through Standard Contractual Clauses (SCCs) approved by the European Commission.
7. Data Retention
Account and usage data is retained for the duration of your subscription plus 30 days after termination. Billing records are retained for 5 years as required by Polish accounting law.
8. Your Rights Under GDPR
You have the right to access, rectify, erase, restrict, and port your data, and to object to processing. To exercise these rights, contact privacy@psilynx.com. You may also lodge a complaint with the Polish Data Protection Authority (UODO) at uodo.gov.pl.
9. Data Security
We implement encrypted data transmission (TLS), hashed password storage, access controls, and regular security reviews. In the event of a data breach likely to result in high risk to your rights, we will notify you without undue delay as required by GDPR Art. 34.
Refund Policy
1. General Policy
All subscription fees are generally non-refundable. When you subscribe to a paid plan, you are purchasing access to the Service for the billing period. However, we handle each case fairly and promptly.
2. Eligible Refund Cases
You are entitled to request a refund in the following circumstances: duplicate charge; failed cancellation due to a system error on our side; unauthorized charge reported within 14 days; extended service outage (72+ consecutive hours); or EU consumer right of withdrawal for first-time subscribers who have not yet used the Service.
3. How to Request a Refund
Email support@psilynx.com with subject "Refund Request". Include your account email, charge date, amount, and a brief description. We will respond within 5 business days. Approved refunds appear within 5–10 business days.
4. Partial Refunds
For eligible cases involving a partial billing period, we may issue a pro-rated refund based on the unused portion of the billing period.
5. Non-Refundable Situations
We do not issue refunds for: change of mind after using the Service; forgetting to cancel before renewal; dissatisfaction with Lighthouse scores; or accounts terminated for violating these Terms.
